Terms & Conditions

These Terms & Conditions (“Agreement”) outline the relationship between Menu Wizpro (“we,” “our,” “us”) and the Client (“you,” “your”) for all digital services provided. By requesting services, paying an invoice, or beginning a project, you agree to these terms.
1. Services Provided
Menu Wizpro provides digital and creative services, including:
- Website development & design
- E-commerce setup
- Automations & integrations
- CRM and workflow setup
- Content creation & editing
- Branding, graphics, and UI/UX
- Basic SEO setup
- Ongoing support (if purchased)
Any service not listed in the Scope of Work (SOW) will be billed as additional work.
2. Scope of Work (SOW)
Before work begins, a Scope of Work will outline:
- Included features
- Deliverables
- Revision limits
- Timeline
- Pricing
- Integrations
Any request outside the SOW requires a change order and may incur additional fees.
3. Payment Terms
To begin any project, Menu Wizpro requires a 50% non-refundable deposit, unless stated otherwise in writing.
Payment structure:
- 50% Deposit – Required to secure your spot and begin work
- 50% Final Payment – Due before launch, delivery, or handoff
Additional payment terms:
- Work will not begin until the deposit is received.
- Final payment must be completed prior to website launch or content delivery.
- Late payments may delay the project timeline.
- Late fees may apply to overdue invoices.
- Work pauses if payments are not made on time.
4. Revisions
Each project includes a set number of revision rounds outlined in the SOW.
- Revisions must be sent as one consolidated list per round.
- Additional revisions are billed separately.
- Revisions do not include new pages, redesigns, or added features.
5. Client Responsibilities
The Client agrees to provide:
- Required content (logos, text, product details, images, brand assets, etc.)
- Timely communication and feedback
- Access to necessary accounts
- Legally owned or licensed content
Menu Wizpro is not responsible for delays caused by missing content or lack of access.
6. Timelines
Timelines are estimates and may shift based on:
- Client responsiveness
- Content submission
- Scope changes
- Technical factors
Project timelines begin only after all required materials and the 50% deposit are received.
7. Third-Party Tools & Software
Menu Wizpro may use or integrate external tools based on project needs. We are not responsible for:
- Software outages
- Platform limitations
- Third-party billing or subscription fees
- Errors caused by external services
All subscription fees are the Client’s responsibility unless agreed otherwise.
8. Launch & Handover
Launch or handoff occurs only after:
- All deliverables are completed
- The Client submits all required content
- The final payment is made in full
Post-launch updates or edits are considered new work unless covered under a maintenance plan.
9. Ownership & Intellectual Property
After final payment:
- All custom work becomes the Client’s property.
- Menu Wizpro retains the right to showcase the project for portfolio and marketing use unless confidentiality is requested in writing.
- Third-party assets remain subject to their original licenses.
10. Refund Policy
All payments made to Menu Wizpro are non-refundable.
If a Client cancels the project after work has begun:
- The initial 50% deposit is forfeited
- Any additional completed work must be paid for
- No refunds will be issued for time already spent
11. Maintenance & Support
Post-launch support is not automatically included. Maintenance plans may cover:
- Updates
- Fixes
- Minor content edits
- Security checks
- Small design adjustments
Major changes or new features require separate billing.
12. Liability
Menu Wizpro is not responsible for:
- Revenue loss
- Client-side changes causing issues
- Platform downtime
- Security problems due to weak credentials
- SEO ranking changes
- Errors caused by third-party services
Our liability is limited to work performed directly by Menu Wizpro.
13. Confidentiality
Both parties agree to keep sensitive information confidential. We do not sell or share client data outside of necessary project functions.
14. Termination
Either party may terminate with written notice. The Client must pay for:
- All completed work
- Work in progress
- Outstanding invoices
Menu Wizpro may terminate a project due to non-payment, unresponsiveness, or misconduct.
15. Governing Law
This Agreement is governed by the laws of the State of Florida, USA.
16. Acceptance
By paying an invoice, submitting documents, or requesting Menu Wizpro to begin work, you confirm your acceptance of these Terms & Conditions.
17. SMS Messaging Terms
By providing your phone number and opting in, you agree to receive SMS messages from Menu Wizpro related to services you have requested. These messages may be sent using automated or manual systems.
Message frequency varies. Message and data rates may apply depending on your mobile carrier.
You may opt out at any time by replying STOP. For help, reply HELP or contact us directly. Consent to receive SMS messages is not a condition of purchase or service.
Menu Wizpro is not responsible for delayed or undelivered messages due to carrier or network issues.
18. No Trades or Bartering
Menu Wizpro does not participate in any form of service-for-service exchanges, trades, or bartering agreements. All services provided must be compensated through monetary payment terms outlined in the client’s invoice or service agreement. Requests for trades or non-monetary compensation will not be accepted under any circumstances.
19. Changes to This Policy
We may update these Terms & Conditions from time to time. Any changes will be posted on this page with an updated effective date.
